General conditions of sale
The following terms and conditions apply to our Website. These terms and conditions are effective as of January 2021.
Article 1 – General conditions of online sale – acceptance of the conditions
These general terms and conditions of sale (the "General Terms and Conditions"), which define the rights and obligations of the parties to the distance selling contract, apply automatically to the contractual relations between SAS ARTERRITOIRES with a capital of 25,000 euros, whose registered office is located at 27 rue Bernard Dauchez, 95420 Saint-Gervais, registered in the Pontoise trade and companies register under number 890 725 971 000 18 (hereinafter "ARTERRITOIRES") and whose VAT number is FR03890725971, and any Customer placing an order for Products (hereinafter referred to as the "Customer"), on the Website at www.arterritoires.com (hereinafter referred to as the "Site"). Any validation of an order via the Site entails the full and complete acceptance of the General Terms and Conditions by the Customer, without reservation.
No specific conditions other than those of the company ARTERRITOIRES may prevail over these General Conditions. Any contrary clause will therefore be unenforceable, regardless of when it may have been brought to the attention of the company ARTERRITOIRES.
Furthermore, ARTERRITOIRES reserves the right to modify these General Conditions at any time, however, the modifications can only apply to orders validated after the update of said General Conditions.
Article 2 – Order process
Before placing an order, the Customer selects the desired Product, the characteristics of which (in particular name, price, quantity, support, particularities) which he declares to accept, have been transmitted to him or appear on the Site.
The Customer must then provide certain valid identification data, necessary to identify him, namely: surname, first name, billing address, delivery address if different from the billing address, email address, telephone number.
The Customer may, if they wish, create an account on the site in order to keep their identification data for a possible future purchase.
The Customer, after checking the box indicating that he has read and accepted the General Conditions, then confirms his order and proceeds to the payment of the price and delivery costs by choosing the payment method, namely money order, credit card, PayPal, or check. In the latter case, the customer must contact ARTERRITOIRES directly.
A summary of the order will be accessible to the Customer via their Customer account if they have opened one, or via the email sent to them after validation of the order.
In the event of non-compliance with the General Conditions by the Customer, particularly with regard to the payment of an order, ARTERRITOIRES reserves the right to suspend its service and, where applicable, suspend or terminate the Customer's account. Prior to any such measure, the Customer will be notified as soon as possible by ARTERRITOIRES, mentioning the possibility for the latter to regularize his situation, as well as the possibility of contesting the elements with which he is accused. Consequently, ARTERRITOIRES reserves the right to refuse any order from a Customer with whom such an unresolved dispute exists.
In accordance with Article 10 of the General Conditions, the Client has in all cases a right to oppose, access and rectify all data concerning him/her stored by ARTERRITOIRES.
Article 3 – Price
The prices of the Products sold on the ARTERRITOIRES website are indicated in euros, all taxes included, and are subject to variation during the year. However, it is specified that the Products are invoiced at the price in effect when the order is validated by the Customer.
Delivery costs are mentioned separately, at the time of validation of the order, before payment and depend on the delivery option chosen, the nature and weight of the Product ordered. They are therefore invoiced in addition to the price of the Product(s) ordered, except in exceptional cases, in which case expressly mentioned.
Furthermore, for all Products delivered outside the European Union and outside the French Overseas Territories, ARTERRITOIRES draws the Customer's attention to the fact that customs duties or other local taxes or import duties or state taxes may be required, to the extent that the Customer is considered the importer of the Products. These duties and taxes are not the responsibility of ARTERRITOIRES. They will be borne by the Customer and are their sole responsibility, both in terms of declarations and payments to the competent authorities and/or bodies of the importing country. ARTERRITOIRES advises the Customer to inquire about these aspects with the local authorities of the importing country.
Article 4 – Payment terms
Payment for the price of the Products ordered is made in cash upon ordering via our secure payment system or by administrative order upon delivery, or by check. Delivery of the Product(s) ordered takes place after confirmation of the agreement of the bank payment centers. In the event of refusal of authorization, the Customer will receive an email notifying them of the cancellation of the order and the reason for this refusal.
The Customer guarantees that he/she is fully authorized to use the credit card, checkbook, PayPal account or money order used to pay for his/her order.
Acceptance of the Customer's order by ARTERRITOIRES is evidenced by sending the order confirmation email to the Customer.
For administrations, the order will be validated after verification of the data on the Chorus Pro website or any other recommended platform. An invoice will be submitted to the platform and sent to the billing address indicated on the order. Any amount unpaid by the end of the 30-day administrative mandate will incur, without prior formal notice, interest at the rate in effect on the due date.
Article 5 – Delivery – Availability
5.1 Availability of Products
Product offers are valid as long as they are visible on the Site and within the limits of available stocks.
If one of the Products turns out to be unavailable after the Customer has validated the order, the Customer will be informed by email, with the expected restocking times for this product, in order to allow him, if necessary, to abandon his order or place a new one. In any event, his account will be re-credited within 10 days with the amount of the Product ordered but not delivered. The remainder of the order will be delivered normally, the Customer already indicating his agreement for a partial delivery.
5.2 Place of delivery
Orders placed through our Site can be shipped worldwide.
All orders are delivered to the delivery address indicated at the time of ordering or by default in the Customer contact form appearing in their account. In the event of an error on the part of the Customer when communicating their data or insufficient information, resulting in the return of the Product by the carrier, it will be reshipped at their expense.
5.3 Delivery times
The delivery time mentioned in the order summary corresponds to the manufacturing time and the shipping time indicated when choosing the carrier.
In the event of delivery by a carrier requiring an appointment with the Customer, the latter will contact the Customer as soon as possible to arrange a delivery appointment. ARTERRITOIRES cannot be held responsible for a delay in delivery due exclusively to the unavailability of the Customer after several appointment proposals by the carrier.
When the Customer orders several Products at the same time and these have different delivery times, the delivery time of the order is based on the most distant delivery time. However, ARTERRITOIRES reserves the right to split shipments. Participation in processing and shipping costs will only be charged for a single shipment.
In the event of a delay in shipping, an email will be sent to the Customer to inform them of any possible impact on the delivery time indicated to them.
In any event, in accordance with legal provisions, in the event of late delivery, the Customer has the option of terminating the contract under the terms and conditions defined in Article L 216-2 of the Consumer Code.
The Customer is also invited to regularly consult their order tracking and to contact customer service for any questions or in the event of a problem.
Article 6 – Retention of title
ARTERRITOIRES expressly reserves ownership of the Products delivered until full payment of their price in principal and interest, if applicable. Failure to pay may result in ARTERRITOIRES claiming the Products. The above provisions do not prevent the transfer to the Customer of the risks of loss or deterioration of the Products, as well as any damage they may cause, from the date of receipt by the Customer.
Article 7 – Right of withdrawal – Return
7.1. Exercise of the right of withdrawal
The Customer has the right to withdraw without giving any reason within fourteen days. The withdrawal period expires fourteen days after the day on which the Customer, or a third party other than the carrier and designated by the Customer, takes physical possession of the Product(s).
To exercise the right of withdrawal, the Customer must notify their decision to withdraw from the order by means of an unambiguous declaration (for example, letter sent by post, fax or email) to the following address: ARTERRITOIRES, 27 rue Bernard Dauchez 95420 Saint Gervais or to the email address contact@arterritoires.com
If the Customer decides to exercise his right of withdrawal, he must return the Product in its original packaging, in original condition, accompanied by the delivery note and/or the corresponding invoice within 14 calendar days following the date on which the return request was sent to ARTERRITOIRES. This deadline is deemed to have been respected if the Customer returns the goods before the expiration of the 14-day period. Returned Products travel at the Customer's expense and risk. Products that are not accompanied by their original packaging or that are returned in a condition unfit for sale may be refused by our returns department and may be returned to the Customer: in this case, a refund will not be possible.
Given the significant value of certain Products, the Customer is advised to insure the Products upon their return to ARTERRITOIRES, insofar as the Customer ensures their safekeeping and conservation until receipt by ARTERRITOIRES.
7.2. Reimbursement by ARTERRITORIES
In the event of damage to the order during shipping, a new shipment will be made at our expense. You will simply need to send us photos of the damaged package and, in the case of delivery against signature, notify the carrier of the damage. Any Product returned in breach of the conditions mentioned in the above paragraphs may not be accepted by ARTERRITOIRES: it may therefore not be subject to a refund.
The company ARTERRITOIRES will defer reimbursement until receipt of the Products or until the Customer provides proof of shipment of the goods, the date retained being that of the first of these facts.
In the event of an accepted withdrawal by the Customer, ARTERRITOIRES will reimburse all payments received, including delivery costs (with the exception of additional costs resulting from the fact that the Customer has chosen, where applicable, a delivery method other than the least expensive standard delivery method offered) without undue delay and, in any event, no later than fourteen days from the day on which ARTERRITOIRES was informed of the decision to withdraw. ARTERRITOIRES will make the reimbursement using the same means of payment as that used by the Customer for the initial transaction; in any event, this reimbursement will not incur any costs for the Customer.
7.3 – Products excluded from the right of withdrawal
In accordance with current regulations, the right of withdrawal cannot be exercised for goods unsealed by the customer and which cannot be returned for reasons of hygiene or health protection.
Article 8 – Legal guarantees
As part of the legal guarantee of conformity, the Customer:
Benefits from a period of two years from delivery of the goods to take action against the company ARTERRITOIRES.
May choose between reimbursement or replacement of the goods, subject to the cost conditions provided for in Article L. 217-9 of the Consumer Code, in the event of non-conformity of the Product or if it is defective.
It is recalled that the consumer may decide to implement the guarantee against hidden defects of the thing sold within the meaning of article 1641 of the civil code and that in this case, he may choose between the resolution of the sale or a reduction of the sale price in accordance with article 1644 of the Civil Code.
The provisions of this Article 8 do not prevent the Customer from benefiting from the right of withdrawal provided for in Article 7.
However, the Customer cannot contest conformity by invoking a defect that he knew or could not ignore when he contracted (article L.217-8 of the Consumer Code): the Customer is therefore asked to carefully consult the Product sheets for the description of all the Products.
In all cases, in the absence of abnormal use of the Product (in particular, but not limited to: torn, soiled or improperly colored product), ARTERRITOIRES will not exchange the Product.
In accordance with legal provisions regarding conformity and hidden defects, ARTERRITOIRES will refund or exchange defective Products or those that do not correspond to their description. If the Customer requests a refund, they must first contact the Site at the following email address, explaining the details of the request and the reasons for making it: contact@arterritoires.com
If the return is accepted by ARTERRITOIRES, see the conditions in article 7.
Article 9 – Liability
ARTERRITOIRES cannot be held liable for any indirect or immaterial damages resulting from the use or operation of the Products ordered. Furthermore, the Products comply with French legislation, but ARTERRITOIRES cannot be held liable in the event of non-compliance with the legislation of the country where the Products are delivered: it is the Customer's responsibility to inquire with the authorities of the importing country to find out whether the Product is authorized there.
Furthermore, ARTERRITOIRES cannot be held responsible for the non-performance of the contract concluded, on the one hand in the event of force majeure, as defined by article 1218 of the Civil Code, on the other hand in the event of fault of the Customer or the unforeseeable and insurmountable act of a third party to the contract or the consequences resulting from the improper use of the Products sold on the Site (for example in the event of handling errors during hanging, or in the event of damage caused by improper fixing of the break supports).
Article 10 – Intellectual property – Copyright – Reuse
No element of the Site, including editorial content, graphics, photographs, logos and trademarks may be copied, reproduced, modified, downloaded, published, republished, transmitted or distributed in any form or by any means without the prior written consent of ARTERRITOIRES. Any unauthorized use of the elements appearing on this Site may constitute a violation of regulations or legislation relating to copyright, trademarks or any other applicable legislation, and is punishable by law.
For institutional clients: the loan of an exhibition to another municipality/association/structure is authorized in strict compliance with the following rules: make a prior declaration to ARTERRITOIRES and proceed with the payment of additional royalties. A minimal contribution to administrative costs will also be requested.
Images from exhibitions may only be used for the promotion of exhibitions and must always be accompanied by the name of the artist.
Article 11 – Personal data
In accordance with the French Data Protection Act No. 78-17 of 6 January 1978, you have the right to query, access, modify, oppose and rectify your personal data. By agreeing to these general terms and conditions of sale, you consent to our collection and use of this data for the performance of this contract. ARTERRITOIRES will only use this information within the strict framework of processing the Customer's orders and compiling statistics to improve its Site and the services offered.

Article 12 – Proof
Unless proven otherwise by the Customer, ARTERRITOIRES automatic recording systems are considered as proof of the nature, content and date of the sales contract.
Article 13 – Applicable law – Disputes – Processing of complaints
All clauses appearing in these general conditions of sale, as well as all purchase and sale transactions referred to therein, will be subject to French law.

Unless proven otherwise by the Customer, ARTERRITOIRES automatic recording systems are considered as proof of the nature, content and date of the sales contract.
